1. About these Terms
These Terms of Service govern the use of the Digilaguna website and the provision of services by Digilaguna OÜ.
By using the website or contacting Digilaguna regarding a project, you agree to these Terms where applicable.
These Terms do not replace a separate written agreement, quotation, project specification or other agreement made between Digilaguna OÜ and a client. Where a separate agreement exists, its specific terms take precedence.

3. Our Services
Digilaguna provides digital creative and technical services, which may include:
- Digital visual creation
- AI-assisted visual design
- Branding graphics and banners
- Website and landing page design
- Shopify store setup
- Website maintenance
- SEO-related updates and optimisation
- Other digital design and development services
The exact scope of a project is determined separately based on the client's requirements and the applicable quotation or project agreement.
4. Enquiries and Quotations
Submitting an enquiry through the website does not automatically create a contract or guarantee that Digilaguna will accept the project.
After receiving an enquiry, Digilaguna may contact the client to clarify the requirements and prepare a quotation.
A project becomes binding only after the parties have agreed on the relevant scope, price and other applicable terms.
5. Pricing and Payment
Prices shown on the website may indicate starting prices or examples and do not necessarily represent the final price of an individual project.
The final price depends on the scope, complexity, required revisions, technical requirements and other project-specific factors.
The applicable price and payment schedule will be agreed before the work begins.
Unless otherwise agreed, additional work outside the agreed scope may be charged separately.
6. Project Scope and Changes
The client is responsible for providing accurate information, materials and instructions required for the project.
If the client requests significant changes to the agreed scope after work has started, Digilaguna may revise the project timeline and price.
Minor revisions included in the agreed project scope will be handled according to the specific quotation or project agreement.
7. Client Materials
The client must have the necessary rights and permissions to use any text, images, logos, photographs, trademarks or other materials supplied to Digilaguna.
The client is responsible for claims arising from materials supplied by the client that infringe third-party rights.
8. AI-Assisted Work
Digilaguna may use artificial intelligence and other digital tools as part of the creative process.
Where AI-assisted content is used, the final deliverables may be further edited, composed, refined or otherwise processed by Digilaguna.
The specific rights and permitted uses of final deliverables depend on the applicable project agreement and the third-party tools or assets involved.
9. Intellectual Property
Unless otherwise agreed in writing, Digilaguna retains rights to its own pre-existing materials, templates, methods, processes, concepts, source files and reusable components.
Rights to final project deliverables are transferred or licensed to the client according to the agreed project terms and payment conditions.
Third-party fonts, stock assets, software, plugins, AI services and other third-party materials may be subject to their own licence terms.
10. Website Development
Where Digilaguna provides website development or setup services, the client is responsible for providing the necessary content, account access and other information required to complete the project.
Unless specifically agreed otherwise, ongoing hosting, domain registration, third-party subscriptions, paid plugins, software licences and similar external costs are not automatically included in the project price.
11. Third-Party Services
Projects may involve third-party services such as hosting providers, domain registrars, email services, Shopify, payment providers, software platforms or AI services.
The availability and functionality of third-party services are outside Digilaguna's direct control.
Third-party services may have their own terms, pricing and privacy policies.
12. Delivery and Acceptance
The expected delivery time for a project will depend on its scope and the information and feedback provided by the client.
Delays caused by missing materials, delayed feedback, requested changes or third-party services may affect the delivery schedule.
The client should review delivered work and notify Digilaguna of any issues within a reasonable period.
13. Liability
Digilaguna will perform agreed services with reasonable care and professional skill.
Digilaguna is not responsible for failures, interruptions or losses caused by circumstances outside its reasonable control, including failures of third-party platforms, hosting providers, domain providers, internet services or other external systems.
Nothing in these Terms limits any mandatory rights or remedies that cannot legally be excluded or limited.
14. Consumer Rights
If the client is a consumer, mandatory consumer protection rights under applicable Estonian and European Union law remain unaffected by these Terms.
15. Complaints and Disputes
If you have a complaint concerning a service, please contact Digilaguna first:

16. Website Content
The content published on the Digilaguna website is provided for general informational purposes.
We make reasonable efforts to keep the information accurate and up to date, but service descriptions, pricing examples, availability and other website content may change.

18. Governing Law
These Terms are governed by the laws applicable in the Republic of Estonia, unless mandatory consumer protection rules provide otherwise.
